Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you do not have permission to access the Service.

1. The EbunBox Service

EbunBox provides a personalized gifting concierge service. We are not a traditional retailer. Our service involves:

Consulting with you to understand the recipient and occasion.

Curating, sourcing, and/or procuring gift items based on your input.

Providing custom, elegant packaging for your gift.

Arranging for the delivery of your gift to your specified recipient.

2. User Account

If you create an account on our Service, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security.

3. Service Process and Orders

a) Request Submission: When you submit a Gift Request Form, you are requesting our concierge service. This is an invitation for us to provide you with a quote and proposal for your curated gift.

b) Quotation and Agreement: Submission of a Gift Request Form does not automatically create a binding order. After reviewing your request, we will contact you with a proposed gift idea and a price quote. A binding contract between you and EbunBox is only formed once you explicitly approve the quote and complete payment.

c) Customer Responsibilities: You are solely responsible for the accuracy of the information you provide, including the recipient’s shipping address, interests, and any allergies or preferences. EbunBox is not liable for failures resulting from incorrect information provided by you.

4. Fees and Payment

a) Quoted Price: The price quoted for our service includes our curation fee, the cost of the gift items, custom packaging, and standard shipping. Expedited shipping may incur additional costs.

b) Payment: Payment is required in full upon acceptance of our quote before we begin the sourcing and fulfillment process. We use third-party payment processors, and all payment information is securely transmitted and encrypted.

5. Shipping and Delivery

a) Delivery Estimates: Any delivery or shipping date provided by us is an estimate only. We are not liable for delays in delivery caused by third-party carriers, weather, customs, or other events beyond our reasonable control (“Force Majeure Events”).

b) Title and Risk: Title to and risk of loss for the physical gift passes to you upon our delivery to the shipping carrier.

6. Cancellation Policy

Due to the personalized and time-sensitive nature of our service, cancellation requests must be made immediately.

Before Quote Acceptance: You may cancel your request at any time before approving a quote at no charge.

After Quote Acceptance: Once a quote is accepted and payment is processed, cancellation may only be offered at our sole discretion. If we have not yet begun sourcing or procurement, a partial refund or store credit may be issued, minus any administrative costs incurred. Once sourcing has begun, orders cannot be cancelled.

7. Intellectual Property

All content on the Service, including text, graphics, logos, images, and software, is the property of EbunBox or its content suppliers and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content from the Service without our express written permission.

8. User Conduct

You agree not to use the Service:

For any unlawful purpose.

To submit any material that is false, misleading, or inaccurate.

To harass, abuse, or harm another person.

To impersonate or misrepresent your affiliation with any person or entity.

9. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. EbunBox makes no warranties, expressed or implied, regarding the operation of the Service or the information, content, or products included therein, including any implied warranties of merchantability or fitness for a particular purpose.

10. Limitation of Liability

To the fullest extent permitted by law, EbunBox shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service.

The cost of procurement of substitute goods and services resulting from any goods or services purchased through the Service.

Any conduct or content of any third party on the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless EbunBox and its licensee and licensors, and their employees, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the Service, or your violation of any term of these Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
